The dispute emerged when a Padma Shri awardee brought an internal conflict within their housing society to the court’s attention. The High Court, during the hearing, declined to intervene in the matter, which revolved around the opening of a coffee shop and eatery in Colaba. This decision concluded the case.

Mustansir Burma, a recipient of the Padma Shri award in 2013 and the former director of the Tata Institute of Fundamental Research, resided at Sunny House behind the Taj Mahal Hotel on Merewether Road.

The core of the issue lay in allegations made regarding the unauthorized operations and potential risks posed by the Lambson Hotel and Restaurant Services on the ground floor, which led to the removal of an intermediate floor. The petitioner urged the BMC (Brihanmumbai Municipal Corporation) to halt the work and conduct a survey. In response, Lambson’s counsel refuted concerns about structural damages, stating that the BMC had authorized the repairs. Burma’s legal representation highlighted several instances of buildings collapsing due to similar activities.

Addressing the absence of the society’s involvement, the judge questioned why the society did not file a petition or engage with Burma directly. The society’s counsel referenced an audit report while justifying their stance. Frustration surfaced as the court repeatedly heard mentions of the building’s age (being a century old) and Burma’s status as a Padma Shri awardee.
