In a recent pronouncement, the Delhi High Court emphasized the imperative nature of maintaining an unbiased stance, devoid of gender or occupational stereotypes, in judicial deliberations. Addressing a case where a police officer’s husband was absolved of charges of cruelty under the Indian Penal Code, Justice Swarana Kanta Sharma decried the erroneous presupposition held by the lower court that individuals in law enforcement cannot fall prey to domestic abuse.
The High Court condemned such preconceived notions, asserting that they represent a grave injustice and distortion of justice. It stressed the necessity for judges to embrace gender neutrality not only in their choice of language but also in their underlying mindset. Furthermore, it called for the integration of gender sensitivity in judicial training programs, arguing that principles of justice and equality often take a backseat to biased considerations.
Highlighting the disparity in treatment between the complainant, a female police officer, and her husband, the court underscored the importance of impartiality in judgment. It urged judicial academies to equip judges with the tools necessary to dispense justice without the cloud of gender bias, emphasizing the need for ongoing education in areas such as gender equality and cultural diversity.
Moreover, the court recognized the dichotomy faced by women who excel professionally yet suffer in their personal lives. It advocated for the protection of women’s rights irrespective of their professional status, emphasizing the inherent dignity and entitlement to legal safeguards for every individual, regardless of gender or background.
