Madhavi Viswanathan, the progenitor of television reporter Soumya Viswanathan, has initiated legal proceedings in the Supreme Court contesting the bail bestowed upon four felons, currently serving an existence of incarceration for the homicide of her progeny in 2008. Vishwanathan met her demise in the early hours of September 30, 2008, on Nelson Mandela Marg in the southern precincts of Delhi, whilst traversing homewards in her automobile following a day’s labor. The Delhi High Court, on the 12th of February, extended bail to the accused, remarking on their fourteen-year detention.
The aforementioned tribunal suspended the penalties of Ravi Kapoor, Amit Shukla, Baljeet Singh Malik, and Ajay Kumar, granting them bail for the duration of their appeals contesting the verdict and sentencing.
Per the cause list posted on the apex tribunal’s digital platform, a panel including justices Bela M Trivedi and Pankaj Mithal is anticipated to address the entreaty brought forth by Madhavi Viswanathan, scheduled for Monday.
In the month of November 2023, a specialized tribunal decreed two life sentences upon the four implicated individuals, charged with homicide and also under Section 3(1)(i) (engaging in organized crime leading to the demise of an individual) of the Maharashtra Control of Organized Crime Act (MCOCA). The tribunal explicitly articulated that the sentences would be served “successively”. The fifth convict, Ajay Sethi, was assigned a three-year term of simple detention pursuant to section 411 (illegally receiving purloined assets) of the IPC.
